Bar body under GST, will have to pay tax for parking fee, rent

    CHANDIGARH: The UT excise and taxation department’s internal probe and physical assessment have found that the bar association of the Punjab and Haryana high court is under the GST ambit and liable to pay the tax for collecting Rs 8 lakh to Rs 9 lakh per month as parking fee and rent from shops. The parking lot is situated in the open just opposite the underground parking of the court.

    Now the excise department will serve a show-cause notice on the association for payment of tax and interest and ask it to apply for a GST number to run the parking lot. Sources in the department said earning over Rs 20 lakh annually comes under the tax ambit and one has to apply for a GST number and pay the tax, which was not done in this case.

    “We have found that the association has been earning between Rs 8 lakh and Rs 9 lakh per month from the parking lot and shops’ rent. Out of this, they have been earning about Rs 4 lakh per month from the parking lot alone. Our probe established that the parking was being run from June 2019 and shops prior to that. However, no tax was paid, so we will serve a show-cause notice to pay the tax as well as the interest,” a senior officer involved in the exercise confirmed.

    “The probe also revealed that the bar association gave the parking lot to a contractor through a tender. Therefore, the contractor was running the lot by employing his men,” he added.

    The bar association president, DPS Randhawa, said, “My colleagues are dealing with the parking issue. I will speak on it after talking to them in a day or two.”

    Buying time, but not giving records

    Sources in the Chandigarh administration revealed that the bar association had been seeking time and has failed to submit the record so far. “The body sought time twice in the past over two months from us for giving records and other details in this regard, but has not furnished anything so far. Therefore, we will now serve the notice soon,” a UT official said.

    More parking lots are on the radar of the excise and taxation department. Sources said the department has been making inspections and seeking details of the lots situated in key areas, like internal parking of Elante Mall, Rock Garden, Chandigarh Railway Station, PGIMER, GMCH-32, ISBT-43, ISBT-17 and Sector 17, among others.
