Accept GST returns sans late fees till Feb 12: HC to Centre
The Rajasthan High Court has given big relief to the taxpayers to file GSTR 9 and 9C without late fees and has directed the Centre to file a detailed reply by February 12 about its preparedness and GSTN filing capacity of the server.
The court has also directed the Centre to accept GSTR 9 and GSTR 9C returns without charging any late fees till February 12.
The Tax Bar Association, Jodhpur, had moved the high court through a PIL with regard to the technical glitches being faced by taxpayers in filing GSTR 9/9C on the GSTN portal, which rendered the extended time for filing returns useless.
Arguing in the court, petitioner’s counsel Rahul Lakhwani stated that repeated attempts by taxpayers to file tax returns on the portal during the extended period failed time and again. The petitioner submitted screenshots of these failed attempts and argued that the GSTN portal was not having requisite capacity to handle the filing of pending returns within the deadline.
The counsel informed the court regarding new ways of extension of date by CBIC through its twitter handle.
“Even according to data submitted by the counsel of Centre, the portal at its best day accepted about 20 lakh returns whereas about 30 lakh returns had been pending at 1.30 pm on February 5,” Lakhwani said.
Keeping the arguments on the dismal server capacity of GSTN, the division bench of Chief Justice Indrajit Mahanty and Justice Pushpendra Singh Bhati directed the Centre to file a detailed reply by February 12 about its preparedness and GSTN capacity of the server.
